This Privacy Policy (“Privacy Policy”) describes how Fluxon Apps LLC and its subsidiaries and affiliates ("Fluxon", "us", "we", or "our") collect, use, and share your personal information in connection with the websites and online platforms we own and operate that link to this Privacy Policy (collectively, the "Site"), our emails and other electronic communications, our social media pages, and our related services, offerings, and events (collectively, and together with the Site, the “Platform”), and the rights and choices available to individuals with respect to their personal information. This Privacy Policy does not apply to personal information that we may store or maintain on behalf of the users of our Platform, where applicable.
We may update this Privacy Policy from time to time. We will notify you of changes by posting the new Privacy Policy on this page and changing the “Last Updated” date at the top of this page. Referrals. You may have the opportunity to invite colleagues or other contacts to the Platform and share their contact information with us. Please do not provide us with someone’s personal information unless you have their permission to do so.
Sensitive Personal Information. Unless we specifically request it, we ask that you not provide us with any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Platform, or otherwise to us.

To Provide the Platform and Our Products and Services. We may use your personal information to provide the Platform and our products and services, such as to:
Research and Development. We may use your information for research and development purposes, including to study and improve the Platform and our business, understand and analyze the usage trends and preferences of our users, and develop new features, functionality, products, and services. As part of these activities, we may create aggregated, de-identified, or other anonymized data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes.
Direct Marketing. We may send you direct marketing communications as permitted by law. You may opt-out of our marketing communications as described in the “Your Choices” section below.
Interest-Based Advertising. We work with third-party advertising companies and social media companies to help us advertise our business and to display ads for our products and services and other products or services that may be of interest to you on the Platform and other locations. These companies may use cookies and similar technologies to collect information about you (including the online activity information and device information described above in the section called “Personal Information Collected Automatically”) over time and across our Platform and other sites and services or your interaction with our emails, and that information may be used to serve ads that such companies think will be of interest to you. In addition, some of these companies may use hashed customer lists that we share with them to deliver ads to you and to similar users on their platforms. To Comply with Laws and Regulations. We will use your personal information as we believe necessary or appropriate to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

With Your Consent. In some cases we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.
We may share your personal information with the entities and individuals listed below or as otherwise described in this Privacy Policy or at the point of collection.
Related Companies. We may share personal information with our affiliates, subsidiaries, and other related companies. For example, we may share your personal information with our related companies to provide our products and services to you where such companies perform components of the Platform.
Service Providers. We share personal information with third parties and individuals who perform functions on our behalf and help us run our business. For example, we may work with service providers that help us perform website hosting, maintenance, database management, security, cloud storage, web analytics, billing, email and text message services, payment processing, marketing, advertising, and other purposes.
Business Partners. We may share your personal information with our business partners, such as when we send information to a partner to offer a co-sponsored service or product or participate in any joint marketing efforts.
Advertising Partners. We may also share personal information collected about you with third parties who we partner with for advertising campaigns or that collect information about your activity on the Platform and on other sites and services for the purposes described in the “Interest-Based Advertising” section above.
Law Enforcement, Authorities, and Others. Under certain circumstances, we may disclose your personal information to law enforcement, government authorities, and other parties if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency). Professional Advisors. We may share your personal information with persons, companies, or professional firms providing us with advice and consulting in accounting, administrative, legal, tax, financial, debt collection, and other matters.
Business Transaction Participants. Fluxon is headquartered in the United States, and we may work with service providers in the United States and other countries. Your personal information may be collected, used, and stored in these countries or other locations outside of your home country. Privacy laws in the locations where we handle your personal information may not be as protective as the privacy laws in your home country. By providing your personal information, where applicable law permits, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth herein or in any applicable terms of service.

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.
The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password or username for access to certain parts of our Platform, you are responsible for keeping such information confidential. We ask you not to share your password or username with anyone and to select unique and secure passwords when setting up accounts in our Platform.

Account Information. Depending on the services that you use, you may be able to access, modify, or remove certain information saved in your account by logging into your account and updating or correcting your profile information. You may also submit a request to delete your account by contacting us using the means provided at the bottom of this Privacy Policy.
Promotional Email Communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email or by contacting us as described below. You may continue to receive account, service-related, and other non-marketing emails.
Text Messages. We may offer text message programs as part of the Platform, for which messaging and data rates may apply. You may opt out of receiving text messages at any time by replying to our text message with the word “Stop” or by contacting us as described below. Please note that opting out of receiving text messages may impact your use of the Platform.
Third-Party Platforms. If you choose to connect the Platform with a third-party platform, you may have the ability to limit the information that we obtain from the third party at the time you create your account. You may also be able to control our access to your personal information through your account settings with the third-party platform. Please note, if you withdraw our ability to access certain information from a third-party platform, that choice will not apply to information that we have already received from that third party.
Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and our Site may not work properly. We use services like Google Analytics to help us understand user activity and patterns on the Site. Advertising Choices. Many of the opt-out preferences described in this section must be set on each device and/or browser for which you want them to apply. Please note that some of the advertising companies we work with may not participate in the opt-out mechanisms described above, so even after opting-out, you may still receive interest-based ads from other companies. If you opt-out of interest-based advertisements, you will still see advertisements online but they may be less relevant to you.

Declining to Provide Information. We need to collect personal information to provide certain services. If you do not provide the information requested, we may not be able to provide those services.
The Platform is not intended for use by anyone under the age of 16, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us. If we become aware that we have collected personal information from children without verification of parental consent as required by law, we take steps to remove that information from our servers.
The Platform may contain links to other websites and online services, such as social media websites, that are not operated by us. These links are not an endorsement of, or representation that we are affiliated with, any third party. If you click on a third-party link, you will be directed to that third party's site or service. In addition, our content may be included on web pages or online services that are not associated with us. We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services. Other websites and services follow different rules regarding the collection, use and sharing of your personal information. Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the “sale” of certain types of personal information. Subject to several exceptions, Nevada law defines “sale” to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your “sale” opt-out rights, you may submit a request to us using the contact information listed at the end of this Privacy Policy.
Under California Civil Code Section 1798 (California's “Shine the Light” law), California residents with an established business relationship with us can request information once a year about sharing their personal information with third parties for the third parties' direct marketing purposes. The information provided in this section applies only to individuals in the European Economic Area and the United Kingdom (collectively, “Europe”). Except as otherwise specified, references to “personal information” in this Privacy Policy are equivalent to “personal data” governed by European data protection legislation.

Applicable law may require or permit us to decline your request. If we decline your request, we will tell you why, subject to legal restrictions. Cross-Border Data Transfer. Fluxon complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Fluxon has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Fluxon has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Onward Transfer. Fluxon remains responsible for any of your personal information that is shared under the Onward Transfer Principle with third parties for external processing on our behalf, as described in the “Sharing of Personal Information” section of this Privacy Policy.
Complaints. In compliance with the EU-US Data Privacy Framework Principles, Fluxon commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union, Swiss and United Kingdom individuals with DPF inquiries or complaints should first contact Fluxon at info@fluxon.com. Fluxon is also subject to the investigatory and enforcement powers of the US Federal Trade Commission.
Fluxon has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers for more information and to file a complaint. This service is provided free of charge to you.
